Was it possibly a reference to the seemingly random street closures on a network of one-ways near a freeway entrance? Back in my out-of-town days, I once got kicked all the way up to Dowling by one of these (on account of getting shunted unwillingly to 94 north). What a weird-ass thing to be an a city report. Any decision justified by the city's determination that a relationship is "spousal-type" seems pretty freaking absurd.

The question at issue is if this application is actually an application for a unique business to be run by Heidi Pham, or if she is a front for a business that Thom will actually be running. In that regard it seems like a relevant finding. Also, the report calls it a "domestic partnership" which is actually a legal term in the city of Minneapolis. I believe it's a holdover from the days when same sex marriage wasn't legal and the housing code was getting in the way, but couples could register with the city as a domestic partnership and that at the very least qualified them as a "family" in terms of occupancy limits. I wouldn't find it all strange if after one spouse of a married couple was denied a license, the other spouse requested an almost identical license claiming no business connection to the first spouse. In that same regard I don't find it at all strange that the same determination is made for a couple that isn't married but still operates as a married couple.

What is the procedure for the city to determine if an applicant has a "spousal-type" relationship with a previous licensee? Google search Startribune.com? Hire Sam Spade III for a thorough investigation?

It's not that complicated. The couple have lived together since 1997, Mrs Pham has lived with him the entire time she's lived in U.S., they have four children together and she changed her name to match his. By any reasonable definition their relationship is of husband and wife even if they are not legally married.

The "report" you referenced is a determination by an administrative law hearing officer not city staff. It's pretty clear all determinations of fact are based the applicant's statements in license applications and hearing testimony. The application isn't being denied because of the relationship between the applicant and Mr Pham. It's being denied because he will have a substantial role in the business. Evidence of his involvement doesn't include his personal relationship to the applicant aside from their shared financial obligations.
