I'd presume incompetence before I presume malice.

The city should put its foot down if it happens again with this developer. It can't become a trend. At the same time, development is tough, and occasionally things don't work out cleanly. An occasional small mulligan seems fair. This isn't a small change, but it isn't a massive one either. Overall, the city should also be more lenient towards errors that count in favor of its comprehensive plan goals.
This developer has a history of "incompetence" and the design he's proposing is essentially the design that was rejected several years ago. He's trying to backdoor something he wanted to do in the first place.
That would change things, I'm not aware of the developer's history.

Geberding is seriously really bad at this, it's amazing he's built as many buildings as he has, but he just needs to find some easier projects to work on or just retire already.

Does it all boil down to the Aldi? Does he have anything else going for him to win the appeal?

Gotta hand it to Gerberding. He played the Aldi card to maximum advantage.

His rationale for coming back several months after groundbreaking and asking for a larger project than the one approved by CPED was that requirements imposed by Aldi required a bigger building to be financially viable. He shrewdly recognized that public demand for the Aldi store gave him leverage to bypass CPED and go before the city council to demand a bigger project.

But if I recall correctly, the city denied his request and scolded him, right?

He then went around them to the full city council and won. It was a very ballsy move.

Not saying this didn't happen (and my memory isn't what it once was), but can you point to any news reports confirming this? My googling just shows his appeals being denied.

That Aldi is amazing and it feels really large inside. However I'm not sure about the 8pm closing time. I get it that's an Aldi thing, but I feel like 10pm is more appropriate based on Uptown Cub's busy hours.

I agree. But it's going to take an act of God to change that.

I have a similar grip with the TJ's in DT East closing at 9pm.

I think the limited hours helps them stay efficient, however I feel some of these busy urban locations could sustain longer hours. Funny story the Aldis on Lake St and 21st has a family selling tamales out of their car that taste great and the one on Penn Ave N and Lowry N has a gentleman selling BBQ Chicken Sandwiches I need to try sometime. Different cultures and different foods within our city.
