An Order dismissing the Plaintiff's (NEBL) claim relating to the MERA (MN Environmental Rights Act) has been signed by the judge. This was NEBL's primary argument. The parties have agreed to this.

The next order will relate to whether the demolition will be granted.

If the trial has been canceled, doesn't that mean they can go ahead with demolition/construction?

The court is reviewing each decision separately, so the demolition was the latest to be reviewed and the Order will be signed hopefully anytime now.

I just saw the Order signed by the Judge stating that Alatus and the city correctly followed all procedures allowing for the demolition of the commercial club and construction of a new tower. The counts relating to NEBL's complaints are dismissed.

That's excellent! Now they need to get this thing demolished before any other group decides to try and stop it. This will be a beautiful tower. I will be able to see the construction of it from my living room window.

The NeBL funding push continues to try to raise the rest of the money they're owe the lawyer... there aren't any other options to try to stop this project.

How long is the development company have to wait until they can demolish? I guess I am asking, how long do they have to wait for an appeal to be filed? Let's say, hypothetically, if they tear down the old building tomorrow, then there's no need for an appeal. The job is already done.

Unless the judge (or appeals panel) issues a stay, they don't have to wait at all.

Judgment was entered today. Of course, the parties could agree to hold the demolition for now, but given that NEBL has raised $100 for appeal, I don't think that is going to be a serious issue.

Specifically it says it "has" delayed construction. My interpretation of that would be that the process overall has delayed the start of construction (which is true) but they're still hoping to start in April.

Last time I walked by the funeral home, I saw piles of wood and demo debris inside, which I did not see a month ago.
