Nope, because NEBL would have to appeal to them for that fourth complaint and they haven't even applied to the regular appeals court for that one.

Oral arguments are scheduled at the Appeals court for October 26. Two more months to wait and I am very curious what they will be talking about since NEBL has been shot down on everything.

Yeah, it gets weird real quick because of all the different complaints that are going on. The Supreme Court turned down NEBL on the complaint that the building would be bad for the environment. The bond was sent back to the district court who quickly dismissed all the complaints and closed the case. The height issue was dismissed by the district court and NEBL has not appealed that decision. Of course, NEBL can end the appeal at anytime when they run out of cash.

So what's scheduled at the appeals court then, if the height issue didn't get appealed and the environmental issue is closed?

The District Court is finally going to make a judgment on that bond amount. The final amount will be somewhere between $100,000 and $5.9 million.

If NEBL can't pay, then tye remnants of what's left will crumble apart.

The only thing left in the District Court is the new bond amount for the Stay of demolition.

Update cheat sheet:
Counts 1, 5: Filed 11/21/16, Dismissed by district court 7/24/17, Appeal filed 9/22/17

Counts 2, 3, 4: (MERA claim) Filed 11/21/16, Dismissed by district court 3/30/17 - Appeal filed 5/25/17, Oral argument at Appeals court 10/26/17

Bond: Bond and Stay of demolition granted 5/25/17 for $100,000 - Appeals court remanded back to District Court 6/27/27. Supreme Court petition filed 6/29/17, rejected 8/22/17. District Court signs Order 9/22/17 for NEBL to post a bond of $2.89 million for the City and $1.68 million for Alatus by 4pm on Friday.

So if the bond is not paid, demolition can proceed and then they will finish the arguments in the Appeals court about the MERA (environmental) and height arguments.

By the time this is all done...I am pretty doubtful the tower will still move forward. We shall see.

On the contrary, I don't think Alatus would have wasted this much time only to give up. If there was demand for 40 stories of condos before this neighborhood bull, there's still demand now.
