Today the Appeals court dismissed counts II, III, and IV (MERA environmental argument) as being moot.

Yep, count V is the variances the developer was granted. The District Court pretty easily shot down NEBL on that count, so it should not be a big deal in the Appeals court.

Lets just get this thing built. I wounder how long the devoloper will wait once the court precedings are over. Is feburary the last court thing? Anyone know if all the financing for this is still secured.

Better late than never I guess, but I do trust Alatus to follow through and finish this project. So here's to seeing this finally inch closer to reality.

No, they last stated that they plan to break ground in late Spring 2018. So hopefully with all the legal issues resolved in the next month or two will keep that on schedule.I believe they are anticipating fall for the construction start.

Article goes on to state that they don't plan on breaking ground until Spring 2018, hoping that all the legal challenges will be wrapped up by this winter.

The last time anything this tall was built was the Carlyle in 2007. Which truthfully, I think is a bit sad. There isn't anything nearly this tall proposed by anyone else at this time. I really hope this gets built.

Ouch. The District court has awarded a monetary award (taxation of costs), total of $75,000 to be split between Alatus and the City to be paid by NEBL for fees Alatus and the City paid for all the court actions.
NEBL has got to have no money left after paying their attorneys for over a year, the $100,000 bond to delay demolition, and these $75,000 in fees.

Great. Hopefully they won't be able to carry through on their threat to sue to stop the Expo a block over.

Where does the city's portion go within their budgets and etc? Be great if it could go somewhere productive.

February 6th is the oral arguments on the CUP/height variance, a very poor case based on the threshold NEBL needs to achieve - that then has 90 days to play out and Appeals Court took ~75 days to rule on the MERA claim which was subsequently dismissed on the grounds of mootness. NEBL did take the last MERA ruling (bonding issue) to the Supreme Court but it was not heard. Total timeline for all legal challenges, including Supreme Court hearing appeals, is June 2018.

NEBL did not appeal the MERA/collateral estoppel/mootness ruling to the Supreme Court, so that portion of the complaint has died.

I was being optimistic but it has been over nine weeks so the three judges could sign off at any time. Hopefully it does not take the full 12 weeks.
